Modernization of Inmetro’s Regulatory Model: what is it and where are we going?

To help you understand the process, we have provided a short summary with the main points about the transformation that Inmetro is making in the way it regulates, in order to reach the highest level, in line with the best national and international regulation and inspection practices .

Why change?

The National Institute of Metrology, Quality and Technology (Inmetro), linked to the Ministry of Economy, plays a central role in the Country’s Quality Infrastructure. Among its activities, regulation has very important impacts on the competitiveness, quality and reliability of products and services provided by Brazilian organizations.

But, as society changes, the way of regulating must also change. When Inmetro was created in the 1970s, the main objective was to prepare the national industry to compete in the market for manufactured products. A product was designed to last 30 or 40 years. Now, we are living in the 4th Industrial Revolution, with innovations reaching users quickly and new dynamics in the life cycle of products and services.

But our regulatory system still reflects 20th century paradigms:

  • Very prescriptive and detailed regulations;
  • Bureaucratic processes, without clear value creation;
  • Long and costly process for developing and updating regulations;
  • Regulation established object by object;

In order to act quickly, flexibly and meet what society needs at the moment, this regulatory model has to be modernized.

How will this Regulatory Model be

The modernization proposal is under public consultation, and you can contribute until 05/28. The commitment is to simplify processes, bring more predictability and make intelligent use of information and communication technologies, for a more dynamic regulation, which is stable and permanent and keeps up with market advances.

Guidelines:

  • Alignment with best national and international regulatory and inspection practices.

  • Compatibility with the economy digitization process
  • Development of more comprehensive regulations, where possible based on product categories or risk classes, rather than specific products.
  • Smart inspection and greater accountability of suppliers.

What doesn’t change

The proposed model does not abandon the use of the conformity identification seal – the Inmetro seal – as the main identifier for the consumer that the product follows the standards and technical requirements established for safety and quality.

Inmetro will continue to act as the main supervisor of the market through the bodies of Inmetro’s Brazilian Network of Legal Metrology and Quality (RBMQL-I).

Even though greater autonomy is proposed through a flexible model, all violations of regulated norms remain punishable.

When will the model be deployed?

The proposal in public consultation brings a period of five years for implementation. Even if this deadline is changed after the consultation, there will be a transition phase for the gradual, safe and effective adoption of the model, until it is fully followed.
